Terms and Conditions

These terms are applicable to the goods listed and supplied via our website www.barservices.co.uk (our site) to you. Please read these terms and conditions before ordering products from our site. By ordering goods from our site you agree to abide to by these terms and conditions.

1. Who we are www.barservices.co.uk is a site operated by BAR Services Ltd. Our registered company number is 1288441. The company is registered in England and Wales and our registered office is Tangent House, 62 Exchange Road, Watford, Hertfordshire. WD19 0TG. Our trading address is Moor Hall, Sandhawes Hill, East Grinstead, West Sussex RH19 3NR. Our VAT number is 293 7675 07.

2. Your contract with us.

2.1 When you place an order with us you will receive an e-mail acknowledging that we have received your order. Please be aware that this does not mean that your order has been accepted. An order has not been accepted by us until you receive notification of dispatch and the contract will only be created when that notification has been given.

2.2 Our contract with you will relate to the products that have been dispatched as indicated on your dispatch confirmation.

3. Your rights as a consumer.

3.1 If you are contracting as a consumer (not a business) then under the under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel any order within 14 calendar days starting from the day after your order is delivered.

Unwanted goods can be returned to us in accordance with the above but they must be in the same condition as they were delivered to you. We will refund the price of the goods ordered including the delivery costs to you but you will be responsible for the cost of returning the goods to us.

Please note that at our discretion we can withhold refunds until the goods are received by us and we can make reasonable deductions if there is evidence that the goods may have had use beyond reasonable handling by you.

All refunds will be processed within 14 days of receiving the goods back to us.

4. Delivery.

Unless there are unforeseen circumstances beyond our control, all orders will be delivered within 30 days of the date of dispatch confirmation or sooner.

5. Prices.

5.1 The prices of any goods are as indicated on our site except in cases where there is an obvious error. Taxes applicable such as VAT are indicated.

5.2 Prices for products exclude delivery costs which can be calculated by using the delivery calculator and the total amount will be displayed at the checkout. Some products are subject to a minimum order quantity.

5.3 Prices are subject to variation but any changes will not apply to goods where we have issued you with a dispatch confirmation.

5.4 In the case of obvious pricing errors where it is reasonable for you to recognise the price as an error and the price is lower than it would normally be then we are under no obligation to provide the product even if we have issued you with a dispatch confirmation.

5.6 Payment can be made by the methods indicated at the checkout on our site.

6. Damaged Goods.

All orders should be received undamaged and in good condition however if this is not the case please contact us within 3 days of receipt and we’ll will arrange collection from you. We will then offer to replace the goods or refund the cost.

7. Faulty Goods.

All goods supplied by us are of satisfactory quality and fit for their intended purpose, however in the case of faulty goods please notify us as soon as possible and reasonably practical. We will then arrange to collect the goods and on examination if found to be faulty a replacement or refund including delivery costs will be issued.

8. Liability.

8.1 Our liability for losses you may suffer as result of us breaking these terms and conditions is limited to the purchase price of the product but does not limit our liability in any way for;

(a) death or personal injury caused by our negligence.

(b) fraudulent misrepresentation.

(c) anything under Section 3(2) of the Consumer Protection Act 1987.

8.2 We are not liable for indirect losses if the losses were reasonably foreseeable by you and us when you used our site or the contract was formed.

10. Events outside of our control (Force Majeure).

10.1 We will not be responsible for any failure to perform or delay in performing any of our obligations as a result of;

(a) Strikes or industrial action.

(b) Civil commotion, riot, terrorist attack, war or threat of war.

(c) Fire, explosion, storm, flood, earthquake or other natural disasters.

(d) Failure of the private or public communication networks.

11. Variation.

We reserve the right to change these terms and conditions at any time to reflect changes in the way we conduct our business, technology or regulatory requirements. In the event of variation before dispatch confirmation is sent to you we will communicate with you and give you the option of continuing with your order or cancelling it and receiving a refund of any money paid.

12. Law and Jurisdiction.

Any dispute or claim arising from the use of our site and any products ordered through it will be governed by the laws of England and Wales. Any claims will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

13. Business terms and conditions.

The terms below relate to business sales through our site.

14. Orders.

All orders are accepted subject to these conditions. No order shall be binding unless confirmed by us on our Acknowledgement of Order form.

15. Quotations.

All quotations are subject to withdrawal or amendment by us at any time prior to actual receipt by us of an order for goods referred to therein. Clerical errors are subject to correction.

16. Prices.

Where an order is received for a quantity less than quoted or where delivery is required in instalments smaller than those specified in the quotation, prices quoted may be subject to an increase.

17. Quantity.

Delivery of the quantity ordered, 10% more or less, shall be a good delivery, a pro-rata charge or allowance at the quoted price being made to cover any such variations.

18. Instalments.

Where goods are ordered for delivery by instalments, each instalment will be deemed to be a different contract.

19. Payments.

Subject to satisfactory references being given, payment shall be made 30 days from month end unless agreed in writing by BAR (Services) Ltd. Otherwise payment to be made cash with order or Pro-Forma. No discounts or other deductions will be made.

20. Materials.

Materials of not less than the strength quoted may be substituted for quoted materials.

21. Delivery.

Any delivery time stated is an estimate only and shall not be considered a contractual obligation.

22. Claims.

No liability is accepted (a) for any claims unless given to us, and / or to the carrier where appropriate, within three days of date of dispatch (b) for any loss or damage due directly or indirectly to causes beyond our control or of an indirect or consequential nature.

23. Price variations.

In the event of any change in the cost of raw materials required to fulfill the order, prices quoted may be subject to an appropriate variation.

24. Force Majeure.

The acceptance of an order may be revoked (in whole or part) or delivery dates postponed by us without liability in the event of any contingency beyond our control that does: or is in our opinion, likely to prevent, hinder, delay, interrupt or interfere with the fulfilment of the order or any part of it.

25. Transfer of Title.

Neither ownership nor legal title to the goods shall pass to the buyer until all monies owed by the buyer to BAR (Services) Ltd; whether in respect of this contract or any other contract, are paid to the company by the buyer and until the date of such payment the purchaser shall; if the company so requests, store the goods in such a way that they are clearly shown to be the property of the company in the company’s capacity as fiduciary owner.

26. Limitations of Sellers Liability.

Any express or implied statement, condition of warranty statutory or otherwise, not stated herein is hereby excluded and deemed to be inconsistent herewith. No responsibility is accepted by the seller for any damage or loss arising directly or indirectly out of goods supplied or for any damage or loss arising by reason of any failure of the goods to comply with the specification.
